Delhi enforces strict US$55.31 penalty on open waste, plastic burning as pollution crisis deepens

The order prohibits burning of garbage, leaves, waste plastic among others.

INDIA – As Delhi faces one of its harshest pollution spells this season, the city’s Environment Department has issued a strengthened enforcement directive targeting one of the most persistent contributors to winter smog: the open burning of waste, leaves and plastic.

The move, grounded in National Green Tribunal (NGT) orders from the Vardhaman Kaushik vs Union of India case, signals heightened scrutiny on waste generators, processors, and municipal bodies as regulators push for cleaner urban-air systems.

Under the new order, Deputy Tehsildars and above, as well as Sanitary Inspectors from MCD and NDMC, are now authorized to impose on-the-spot fines of Rs 5,000 (US$55.31) on anyone found burning garbage, leaves, waste plastic, rubber or similar materials in the open.

The mandate strengthens implementation gaps highlighted in recent audits of Delhi’s municipal waste-handling performance, particularly regarding leaf litter and plastic-waste management during peak pollution months.

The collected fines must be deposited directly into the Delhi Pollution Control Committee (DPCC) account, and all authorized officers are required to submit monthly action-taken reports, signaling a more accountable and data-driven approach to monitoring violations.

Wider implications for waste management and recycling industries

The intensified crackdown is expected to place greater operational responsibility on municipal contractors, private waste-management firms and recycling stakeholders.

Industry experts note that open burning is often a symptom of broader system inefficiencies, including gaps in waste collection, seasonal surges in leaf litter, and inadequate segregation of plastic and rubber waste at the source.

As enforcement becomes more stringent, stakeholders anticipate rising demand for mechanized leaf and green-waste collection systems capable of handling high seasonal volumes.

There is also likely to be increased interest in decentralized composting units that can process organic waste closer to the source, reducing the likelihood of burning and easing pressure on landfill-bound collection streams.

At the same time, the directive is expected to stimulate investment in advanced plastic sorting and processing technologies, including optical sorters, AI-enabled segregation systems and chemical recycling infrastructure.

These technologies support the growing emphasis on circularity and help ensure that valuable materials are recovered rather than discarded or burned.

Improved last-mile logistics, particularly in peri-urban and high-density neighbourhoods, will also be essential to eliminating the conditions that lead to open burning, with companies expected to strengthen route optimization, collection frequency, and integration with material recovery facilities.

The move aligns with a wider policy shift encouraging Indian cities to embed circular-economy principles in municipal waste systems.

Delhi’s directive follows repeated recommendations from the Commission for Air Quality Management (CAQM), which has urged North Indian states to close long-standing gaps in waste-handling practices.

Regulators believe that closing these loopholes is critical not only for air-quality improvement but also for strengthening India’s recycling ecosystem and meeting national sustainability targets.

Across the region, other states are also tightening enforcement in response to worsening air-quality trends.

In Haryana, authorities have expanded the use of drones and real-time surveillance tools to monitor and curb crop-residue burning. Punjab has intensified village-level monitoring of stubble-burning incidents, following a noticeable rise in reported cases.

In Uttar Pradesh, industrial clusters such as Noida and Ghaziabad have introduced stricter inspections of waste-burning hotspots and construction sites under GRAP Stage IV restrictions as pollution levels escalate.

Meanwhile, several Indian cities are pursuing emerging technologies, including plastic-to-fuel conversion, biomass briquetting, and chemical recycling pilots, to reduce waste accumulation and create value-added recovery pathways.

These initiatives, together with Delhi’s strengthened enforcement, reflect a growing national push toward cleaner waste management and more resilient circular-economy systems.
